As some bare trusts may be uncertain about the new requirements, the CRA is adopting an education-first approach to compliance and providing relief to bare trusts by waiving the penalty payable under subsection 162(7) of the Income Tax Act for the 2023 tax year in situations where the T3 Return and Schedule 15 are filed after the filing deadline for reasons other than gross negligence. For the 2023 tax year, where the tax year of the trust ends on December 31, 2023, the filing deadline of March 30, 2024, is extended to April 2, 2024, the first business day after the deadline.This proactive relief is for bare trusts only and only for the 2023 tax year. While the Act also includes a gross negligence penalty under subsection 163(5), as part of the CRA’s education-first approach, the CRA will only apply this penalty in the most egregious cases where a bare trust fails to file. Imposing such penalty would only occur in the context of a compliance action, such as an audit, where all factors and circumstances of the taxpayer’s particular situation are considered together. A gross negligence penalty for failing to file will be subject to oversight and approval by Headquarters, following a mandatory referral.Under the Act, the gross negligence penalty is equal to the greater of $2,500 and 5% of the highest amount at any time in the year of the fair market value of all the property held by the trust. ... Dear Lenehan McCain and Associates Client: Please be advised, it is extremely important you read this communication in its entirety. OverviewThe Government of Canada introduced an Underused Housing Tax (UHT) effective January 1, 2022, which imposes a 1% annual tax on the value of residential real estate considered to be vacant or underused that is owned on December 31st of each year. While the tax generally targets property owned by non-Canadians, the scope of filing requirements extends to many Canadian corporations and individuals, including Canadian Controlled Private Corporations (CCPCs), trustees of a trust and partners of a partnership. Filings and taxes are due by April 30th of the following year. For 2022 filings, CRA has provided transitional relief; they will waive any late-filing and late-payment penalties, provided that the return is filed and the UHT is paid by October 31, 2023. Penalties for failure to file the return (even where no tax is payable) start at $5,000 for individuals and $10,000 for corporations.Filing requirements The UHT return is separate from your personal, corporate, partnership or trust tax return. There are two types of owners for the purposes of the UHT: (i) affected owners and (ii) excluded owners. Affected ownersAn affected owner includes, but is not limited to, an owner of residential property in Canada who is a: • a foreign national (not a Canadian citizen or permanent resident);• an individual who is a Canadian citizen or permanent resident, and who owns a residential property in Canada as a trustee of a trust;• an individual who is a Canadian citizen or permanent resident, and who owns a residential property as a partner of a partnership; • A Canadian corporation whose shares are not listed on a Canadian stock exchange designated for Canadian income tax purposes which owns a residential property (i.e. Canadian controlled private corporations which are very common; • A corporation that is incorporated outside of Canada; • A Canadian corporation without share capital.If you are an affected owner of a residential property in Canada on December 31, 2022, you must file a UHT return for the 2022 calendar year by no later than October 31, 2023, to avoid penalties and interest. A return is required for each property you own.Excluded ownersAn excluded owner includes, but is not limited to:• An individual who is a Canadian citizen or permanent resident (unless included in the list of affected owners);• Any person that owns a residential property as a trustee of a mutual fund trust, real estate investment trust or specified investment flow-through (SIFT) trust for Canadian income tax purposes; • A Canadian corporation whose shares are listed on a Canadian stock exchange designated for Canadian income tax purposes; • A registered charity for Canadian income tax purposes; • A cooperative housing corporation, hospital authority, municipality, para-municipal organization, public college, school authority or university for Canadian GST/HST purposes;• An Indigenous governing body or a corporation wholly owned by an Indigenous governing body; • His Majesty in right of Canada. If you are an excluded owner of a residential property in Canada on December 31, 2022, you do not owe tax, nor do you have a UHT filing requirement. Residential propertyThe UHT applies to affected owners who own residential property in Canada. Generally, residential property is defined as property that is either of the following: • a detached house or similar building that contains not more than three dwelling units, and the related land• a semi-detached house, rowhouse unit, residential condominium unit or other similar premises, along with any common areas, and the related landExample #1: A Canadian citizen owns 100% of the shares of a Canadian private corporation in the farming business. The corporation owns a detached house used to provide accommodation to temporary workers. UHT impact – under this scenario the farm corporation would be considered an affected owner of residential property. As such the corporation must file a UHT return. However, the 1% UHT would not apply given the corporation has no foreign ownership (i.e. 100% Canadian owned).Example #2: On December 31 of a calendar year, an individual who is a Canadian citizen is identified in a provincial land registration system as the owner of a detached house located in Canada. The individual is the owner of the residential property in their capacity as a trustee of a trust. UHT impact – the individual is an owner of a residential property in their capacity as a trustee of a trust. Therefore, the individual is an affected owner for UHT purposes. The individual must file a UHT and, depending on the circumstances might have to pay the 1% UHT, unless they qualify for a tax exemption. Non-filing penaltiesThere are significant penalties if the Canada Revenue Agency (CRA) does not receive the return when its due. Below, you’ll find a table depicting the penalties associated with each occurrence of non-filing: Type of affected owner Minimum penalty (per return)Individual $5,000Other than individual (i.e. corporation) $10,000Tax If your ownership of a residential property does not qualify for an exemption from paying the tax for a calendar year, you must calculate what you owe. The UHT rate is 1% of the value of the property.
